3271: Arming Yourself for a Medical Malpractice Battle, Part 2
Course Description
A medical malpractice lawsuit and attendant navigation of the legal system can be the most stressful event in a provider's career and can lead to emotional trauma, burn-out, distrust of patients, over-ordering of tests, and other consequences that present a risk to patient safety and the well-being of the provider. Many of these consequences are due to a lack of understanding of the process and a feeling of loss of control. A better understanding of the legal process and phases of a malpractice trial will help to reduce those consequences and feelings, as well as educate providers on proactive measures that can be taken to reduce the risk of medical error. This seminar (Part 2) will examine in detail an actual malpractice trial from the selection of a jury through the verdict phase and will include reenactment of actual cross examination testimony dissecting the positives and negatives of the providers' testimonies. The consequences of ineffective communication and lack of documentation will be discussed not only from a patient safety standpoint, but also as they relate to the defense of a malpractice claim.
Learning Objectives
- Summarize the phases of a medical malpractice trial
- Explain how being inattentive to the patient, having poor communication, a lack of documentation, and failure to review chart notes, affects the defensibility of a malpractice lawsuit as well as patient outcomes
- Evaluate the duty of a specialist, the necessity of accurate and consistent testimony, and the role of a jury in a malpractice trial
