NOT ELIGIBLE FOR PREMIUM CREDIT
The HIPAA Privacy Rule requires covered entities to provide patients with access to their protected health information, or PHI, contained within the patient's designated record set and provide a copy in the format requested. Our course on Patient Rights and Access provides more information on this. For this presentation, we will discuss what you may charge for physical and electronic copies of medical records, emphasizing what you may not include and how to calculate those costs.
Learning Objectives are:
- Explain the HIPAA Privacy Rule and state-specific regulations regarding the fees for providing copies of medical records.
- Identify the components that can be included in calculating reasonable cost-based fees for copying medical records, including labor, supplies, and postage.
- Apply different methods for calculating fees, such as actual cost per page, average cost per page, and flat fee for electronic copies, ensuring compliance with both HIPAA and state laws.
IMPORTANT:
As you begin to develop your practice’s HIPAA Program, it is important to remember it must be customized to your practice’s unique needs and site-specific information. The SVMIC HIPAA Compliance Manual’s policies and procedures are designed to serve as a template for what the practice should be doing.
